Terms and Conditions

These terms and conditions apply as between “you” (“your”)  and “Nattie Jewellery” (“us” “our” “we”) in relation to the ordering and sale of jewellery products (“Products”) to You (“Terms & Conditions”).

Using this Website 

(a) You may access this website solely for your own personal use. You must not use any content of this website for any illegal purpose.

(d) You agree not cause any nuisance, annoyance or inconvenience to us, our customers or our users of this website.

(e) You agree not post any material to this website (for example: a review) which is false, defamatory, offensive, menacing or obscene, or is reasonably likely to do any of these things.  

Bespoke Jewellery Commissions

Following an initial discussion by email or by telephone, a design fee of £50 is payable if confirmation is received from you by email  to proceed with preparing a design, estimate and an approximate completion timeframe for a bespoke piece of jewellery (“Bespoke Commission”).  

Thereafter a further meeting/discussions would take place (by phone/email/in person) in order to agree a final design, together with revised estimate and completion date.  

The design fee is deducted from any final invoice in the event the Bespoke Commission is completed.  

Any quote for a Bespoke Commission is only valid for 30 days.   

If, after the Bespoke Commission has been agreed, and before any work commences you decide not to proceed for whatever reason, then the design fee will be non-refundable. 

If the Bespoke Commission is accepted by you (both design and estimate) then a deposit of 50% of the total estimated price is payable by you. Work will commence once payment is received. 

In the event that work on a Bespoke Commission is started but for technical/design reasons the piece needs to be modified in some way (which is more than minor and has a potential visual impact) then you will be consulted with before any modifications proceed.

If having commenced the Bespoke Commission you instruct us to change the design in a material way such that it involves more time and/or more materials, we reserve the right to increase the estimated price but only after discussion and agreement with you. In the event that agreement cannot be reached then we will deliver the partially completed Bespoke Commission to you (unless you say otherwise) and there will be no balance of the estimated price to pay. However, both the £50 design fee or the 50% deposit will not be repayable. 

The balance of the estimated price (less the £50 deposit) will be payable upon completion. Once payment is received the Bespoke Commission can either be collected in person from us or posted in accordance with our Delivery procedures. 

If any of your own materials (e.g. gemstones) are to be incorporated as part of the Bespoke Commission and it does not then proceed, or is cancelled once work has commenced, the partially completed Bespoke Commission (together with any of your own materials incorporated or not) will be returned to you at your own cost using our Delivery procedures.

Any goods or materials held by us to be incorporated into a Bespoke Commission will be stored securely and insured to their replacement materials value. We will notify you if we retain goods or materials which are not going to be used in order to arrange return. Any returns will be at your expense. 

Delivery times for Bespoke Commissions will be discussed and agreed with you at the design stage. 

Cancellation Rights  - Cooling Off Period for Online Product Purchases 

Our policy on Returns applies to any online Product purchased from us. It does not apply to Bespoke Commissions.

If you are a UK consumer, you have the legal right to cancel your order within 14 days (“Cooling off Period”) following your receipt or physical possession of the Product from us or when a third party other than the carrier and indicated by you receives or has physical possession of the Product.

If you wish to cancel within the Cooling Off Period, you must inform us in writing (e.g. by email. The email address is: studio@nattiejewellery.com).

If you exercise your right to cancel within the Cooling Off Period after receipt of the Product, we will reimburse you the cost of the Product using the same means of payment as you used to pay for the Product, unless you have expressly agreed otherwise. We will withhold reimbursement until we have received the Product back or you have supplied evidence of having sent back the Product to our reasonable satisfaction, whichever is the earlier.

Please return the unwanted Product to us without delay and in any event not later than 14 days from the day on which you communicate your cancellation to us. Please return the Product following our Returning Products. 

You will be responsible for the cost of returning the Product (including insurance) unless our Returns Policy states that we will reimburse the costs of returning them, or if we delivered Products in error to you, or they were damaged or defective.

Returning Products 

On-line purchased Products may be returned for a refund within 14 days of receiving them in accordance with your Cancellation Rights.

The following items cannot be returned:

  • Pierced jewellery (e.g. earrings) Products for hygiene reasons, unless faulty.

  • Any Bespoke Commission unless damaged or defective. 

  • Nattie Jewellery Gift Cards.

During busy periods, please allow up to 10 working days for your return to be processed once it is received by us. All refunds will be made to the original method of payment. Once a refund has been issued, please allow up to 5 working days for this to appear on your account.

We can accept returns in person at our business premises but only by prior arrangement..

If you are using a tracked returns service (e.g. Royal Mail, Evri, DPD), please keep the tracking number safe so you can quote it in any necessary correspondence.

All items must be returned in a fully resalable condition, which means being unused with any tags attached and, if possible, in the original packaging. Nattie Jewellery reserves the right to refuse a refund on Products deemed not to be resalable. This does not affect your statutory rights in connection with faulty items.

Returns  - Bespoke Commissions 

Once the Bespoke Commission has been completed and delivered to you we do not accept any return for a refund should you then decide you no longer want the Product.

Intellectual Property Rights

(a) The Site and its content are protected by intellectual property rights, including copyright and trademarks, as detailed in our Copyright and Trademark Notice.

(b) The content on this website is protected under the Copyright, Designs and Patents Act 1988 and is Copyright © by Nattie Jewellery. All rights are reserved. Reproduction and/or transmission of any content, by any means, without the express permission of 

(c) Except as expressly authorised by Nattie Jewellery, you agree not to copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute or create derivative works of any content of this website.

Disclaimers

(a) Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis and we do not guarantee that the website will be suitable for your purposes or requirements. 

(b) The website is accessed via the World Wide Web which is independent of us. Your use of the World Wide Web is solely at your own risk and subject to all applicable national and international laws and regulations. We shall have no responsibility for all information or service obtained by you on the World Wide Web.

(c) The content of the website has been compiled from a variety of sources and is subject to change without notice. We use reasonable care in compiling and presenting the content of the website, but we give no guarantee that the content is complete, accurate, error or virus free or up to date. We will have no responsibility for any variations in colour or appearance caused by your browser software or computer system. Product specifications and descriptions are not intended to be binding and are intended to only give a general description of the products.

(d) So far as permitted by law, we disclaim all warranties, conditions and other terms of any kind, whether express or implied, whether in contract, tort (including liability for negligence) or otherwise, including, but not limited to any implied term of satisfactory quality, fitness for a particular purpose, and any standard of reasonable care and skill. We will not be liable for any delay or failure to perform or comply with our obligations under these Terms & Conditions if the delay or failure arises from any cause, which is beyond our reasonable control.

Limitation of Liability

So far as permitted by law, and except in respect of death or personal injury arising from negligence, Nattie Jewellery excludes any liability for loss or damage of any kind resulting from the use of this website (including the reliance upon any information contained on it). Nattie Jewellery is not responsible for any delay or failure to comply with its obligations under these Terms & Conditions. This does not affect your legal right to have Products sent within a reasonable time or to receive a refund if Products cannot be supplied within a reasonable time.

Privacy Policy

Any personal data which you may provide us through the Site is subject to our Privacy Policy.

General Information

(a) These Terms & Conditions together with any further terms for the purchase of Products and documentation and materials referenced in these Terms & Conditions including our Delivery Options policy on Returns constitute the entire agreement between you and us.

(b) Any failure by us to exercise or enforce any right or provision of the Terms & Conditions shall not constitute a waiver of such right or provision.

(c) These Terms & Conditions and the relationship between you and us shall be governed by the laws of England and the English courts shall have the exclusive jurisdiction over any dispute.

(d) We reserve the right to vary these Terms & Conditions and any of our policies from time to time, such variations becoming effective immediately upon posting to this website and by continuing to use it, you will be deemed to accept any such variations.

You will be subject to these Terms & Conditions as in force at the time that you ordered Products from us, unless any change to those terms and conditions is required by law in which case it may apply to order previously placed by you.

Acceptance

You agree that your order is an offer to purchase Products from Nattie Jewellery. All orders are subject to acceptance by us. We may choose not to accept your order for any reason without liability to you.

After submitting an order, we will send you an order acknowledgement email with your order number and details of the Product you have ordered from us and details of any delivery services you have ordered from us.

Please note that this email is an acknowledgement that we have received your order and is not an acceptance of your order. Acceptance of your order and the formation of:

(a) a contract of sale for the Products between Nattie Jewellery and you; and

(b) as applicable a contract for any delivery services between you and Nattie Jewellery in respect of delivery to residents in the UK, the Isle of Man, the EU and outside of the EU will not take place unless and until the earlier of (i) the date on which we receive payment in full or (ii) when we dispatch the Product to you.
